Lack of enforcement leads to abuse of compliance: PM

PRIME Minister James Marape says there are laws in place that guide which businesses foreigners and locals can run but it was the lack of proper policing that had seen abuse.
Marape said in Parliament yesterday that he had instructed the Ministers for Commerce and Industry, Labour and Immigration to work together to effectively addressing the matter.
He said the Government was encouraging investors to come in and do business but they needed to come in at a certain level.
“There are some laws already in place and the Minister for Commerce and Industry is working to progress the agenda and work on policing existing laws and strengthening those laws must be done,” Marape said.
“We must ensure that foreigners must not engage in businesses that Papua New Guineans can be engage in.
“We must make the correct interventions and it is a signal to those who are in our country who are operating tucker boxes and operating businesses that Papua New Guineans can operate.
“Commerce and Industry, Labour Department and Immigration are now being tasked to put together a joint ministerial team to look into this issue.
“Hopefully when Parliament resumes next year, we can report back on the status.”
Marape said there were three bills being worked on by the Department of Commerce and Industry to address the issue and would be tabled in due course.

  • Prime Minister as you have rightfully pointed out, it is not only that, PNG has its Laws in place and departments, commissions and authorities are set up to manage and enforce this laws without fear and favor.

    The current scenario unfolds in as many forms for non compliance however there is three major ones,
    1. Lack of proper planning and budgeting which may be affected by financial constraints – Government funding.
    2. Bribery of enforcing officers is inevitable which is showing incompetency, dishonesty, disrespect, lacking integrity, systematic people (meaning old public servants with no control), mismanagement, no systems in the institutions to properly capture, monitor and check on enforces enforcing the laws.
    3. Political influence from the highest office is also inevitable, it is happening and you see the evidences like what the PM has stated here.
    Whilst this are mentioned, the good Prime Minister should think of;
    1. Review Top Management performances and hold them accountable for any breach by their employees that are found guilty and no actions taken, simple things like scratching a official government vehicle, late submissions of reports, not approving and returning of permits, licenses, certificates, etc on timely basis.
    2. Funding made available for enforcement officers’ knowledge and skills upgrade to be on par with the international level, adjust to new technologies and integrate with the rest of the world on a practical and systematic approach.
    3. Strict recruitment requirements, one particular is for enforces to be working in their fields for over five years to be eligible for employment so they can practically enforce the laws from experiences. Change those managers who have no experiences at all in the real working arena and appoint appropriate and competent persons for decisive and confidence decision makings.
    4. Create an open platform where employees can report corrupt practices, it shall be a systematic approach where the reporter is protected at all cost. The plat form should be seen to be effectively working and the appointments should be through very strict checks, people with integrity and self respect, if need be, employ experts for that matter and this body should be totally protected by a law as well as being completely independent with no government strings attached, appointment should be done by an international body.

    There may be other suggestions however the important thing here is honesty, integrity, maturity, competency, and self-respect to be showcased by each and every enforces of any laws.
