Magistrate orders investigator to appear in court tomorrow

AN officer investigating a murder in Lae has been ordered to appear in court tomorrow and explain the delay in submitting a police case file.
Committal Court magistrate Pious Tapil told prosecutor Sgt Vincent Suakai to have the arresting officer appear during the next mention tomorrow.
Accused Lester Yauna, 28, from Huon Gulf’s Amoa village in Morobe first appeared last Oct 16 and was remanded in custody.
In an earlier appearance, the arresting officer had written to the court on Feb 23 advising that the police file was not ready because of a delay in the medical report.
Tapil said there had been no progress report since then and ordered that the investigator appear and explain.
Police alleged that Yauna, last Sept 29 at about 11pm, committed the crime at Lae’s Bumbu compound in the company of his three family members. They were allegedly drunk.
Reports said the three, after drinking at the DCA beachfront, went to China Town’s 13A market.
Upon returning, they met the deceased and Yanua allegedly hit him on the back of his head with an empty beer bottle.
Another person joined in and hit the deceased and he fell to the ground.
The court heard that the next day, the deceased collapsed and was taken to Angau’s emergency ward but was pronounced dead on arrival.
Yauna was later taken to the police by community leaders, arrested and charged with murder.
He will appear for mention tomorrow.
