A man from Myanmar charged with attempted murder of a Korean will be deported after his case was struck out by a Committal Court in Waigani on Thursday.
Committal Court Magistrate Albert Daniels struck out the case against Lwin Ko Lat, 47, from Yongon’s Tagida village in Myanmar, because the arresting officer was in Madang and could not provide evidence in the case that was transferred to Port Moresby.
“The case is struck out for lack of prosecution since there is no police evidence and he will be under the custody of Immigration for deportation,” he ordered.
Defence lawyer David Kayok informed the court that all complainants in the case against his client were deported to their country of origin after the incident.
Police prosecutor Sgt Gibol Mol informed the court they had no evidence to offer in court as the arresting officer was in Madang.
According to police facts, Lwin was working as a seaman on the shipping vessel, MV Golden Sky, without proper entry permit and visa.
The vessel was crossing over Vitiaz Strait heading to Australia when the incident happened on board last October.
Out of court, Lwin was taken by Immigration officers to the detention centre for him to be deported to Myanmar, as he does not have proper entry permit and valid visa to stay in the country.
