Man gets 46yrs for incest

THE NATIONAL Court has jailed a man who raped his biological sister in Port Moresby for 46 years.
Judge Nicholas Miviri told the 31-year-old at Waigani yesterday that rape and incest were serious offences and this was reflected in the sentence.
“The family is the basic unit of the society and the siblings should protect each other,” Miviri said.
“The family must be the safe and secure unit. It is the cornerstone because from it come the members of the community, province and the State.” It was before the court that on June 3 and 7 of 2020 the brother came home drunk and touched his sister’s breast and then raped her in a room they rented at Hohola.
This happened when the brother’s wife had been away at her village in Southern Highlands.
Miviri said the brother had denied the allegation which forced the sister to testify in court.
The brother was charged with two counts of rape and one count of sexual touching.
He said both were from the same parents and the brother’s conviction showed a serious breach of the familial relationship.
“It is also a crime of incest and here force was used. The brother is the elder in the family and he should be at the front line to protect her. Instead, he violated her grievously and without remorse.”
Miviri said the brother could not use his drunkeness as an excuse for why he committed the crime.
“The brother is well educated to grade 12 and has a diploma in information technology. But this did not deter him from commiting the offence against his blood sister. He persisted and assaulted her and raped her,” he said.
Miviri then sentenced the brother to 20 years each for the two counts of rape and six years for the sexual touching for a total sentence of 46 years.
He deducted 16 years and the brother is now to serve a balance of 30 years in Bomana prison.
