THE National Court at Waigani has found a man guilty of stealing K500 from his uncle in Port Moresby a year ago.
Acting Judge Laura Wawun-Kuvi told Roger Kanda Amu, from Papayuku village in Laiagam, Enga, that the court had found him guilty of stealing because he used the money for his personal benefit.
Roger’s uncle, Wasa Amu, was the managing director of a security firm Wap and Co Ltd.
On Aug 7, 2020, Roger and the company mechanic Willie Gamut went to see Wasa and informed him that they needed money to buy vehicle parts.
Roger was working as an assistant mechanic for the firm at that time.
Wasa gave them K2,500 in cash, however, he did not receive any receipts on the purchase of vehicle parts.
Gamut and Roger used K500 for their own purpose and not for vehicle parts.
Wawun-Kuvi, in sighting similar cases noted that: “In former cases, money remained the property of the person who handed it over.
“In the present case, Roger and Gamut were given the money specifically with specific directions for the purchase of motor vehicle parts.
“Roger’s actions for taking the money and using it were not according to the directions for which the money was given by the owner.
“If you have not used it to purchase vehicle parts, the money should have been returned to the owner.
“The money was used for personal benefit other than purchase of vehicle parts that is the reason the court has found you guilty.”
The matter returns to court tomorrow for submission on sentence.
