No-show forces court to defer Oxley Equity case

The National Court has adjourned an urgent application filed by Oxley Equity Ltd against Clarence Hoot and Melanesian Trust Services (MTS) to Wednesday because the plaintiffs did not turn up in court.
The plaintiff in the matter is Oxley Equity Ltd and the defendants Clarence Hoot and MTS.
Judge Ere Kariko in the Waigani National Court on Wednesday said the matter was not treated as an urgent application by the plaintiff.
“It’s five minutes past the time,” he said. “We should have this matter adjourned.”
MTS had also filed proceedings of a special fixture hearing, and a motion regarding the matter, however, Justice Kariko adjourned all matters to Oct 17 because the plaintiff was not in court to reveal what the matter concerned.
Meanwhile another interested party to the matter, Securities Commission, also appeared and submitted to join the case but their submission was refused by the court.
