Official requests court strike out case

PNG Customs service internal affairs director Brian Lily White has filed a motion in the Committal Court to have his case struck out for defective search warrant.
White was arrested on May 9 and charged with one count of abuse of office and one count of misappropriation for allegedly failing to provide evidence on the whereabouts of certain contrabands confiscated in Lae nine years ago.
His lawyer Derrick Dusava told the court at Waigani yesterday that the search warrant which the police executed to search the area and had White arrested was illegal.
Magistrate Paul Puri Nii then asked Dusava to serve police prosecution with the notice of motion and set July 18 for hearing.
Police alleged that in Febuary 2012, the National Criminal Intelligence Unit (NCIU) caught a shipping container with two M4 enhanced rifles, six pistols, more than 200 bullets and other illegal imports.
It was alleged that KK Kingstone Ltd and its employee brought those contrabands in from Philippines.
The contrabands were confiscated and Customs had possession of the firearms and bullets that must be destroyed after 30 days. Police summary of facts said White, being in his position as the director of customs internal affairs, was responsible for safekeeping of the firearms and bullets including the contrabands.
