A FATHER-of-three has been ordered to pay a man K18,000 for defrauding him of K16,000 in 2022.
Failing to settle in a year from March 25, Kasen Tosio will be arrested and locked up to serve a four-year jail term, National Court judge Lawrence Kangwia ordered last Friday.
Tosio had pleaded guilty to a count of stealing by false pretence.
When taking into account the situation of victim Soni Buso, the judge told the convict that if he was to go to jail for the whole four years, it would serve no useful purpose for the victim.
“He will not get his money back while you are in prison. Therefore, it is in the interest of justice that you be ordered to repay what you and your in-law got from the victim,” Kangwia said during sentencing.
Tosio was also ordered to be ongood behaviour for two years, and to pay the victim a total of K18,000 within one year from Monday. Failing that, the convict will go to jail.
It was reported that the prisoner and his in-law had promised to sell a Toyota Land Cruiser vehicle to Buso. They entered into an agreement on Sept 23, 2022 in Lae for a sum of K16,000. But, after receiving the money, the in-law disappeared.
Kangwia said such offences were prevalent in the country and warned people to be cautious of such thievery.
