Person guilty of adultery can be fined up to K500

THE magistrate of the National Capital District Family Court Laura Kuvi said those found guilty of committing adultery can only be ordered to pay a maximum compensation of K500 each.
“But the court will also consider other factors such as whether they can afford to pay the amount and the length of the adulterous relationship,” she said.
“The maximum compensation cannot exceed K1,000 (for the adulterous couple).”
Kuvi made the remark after a lawyer raised the compensation amount issue when a wife asked the court to order her husband and his extra marital companion to pay K1,000 each.
“They will pay compensation, but the lawyer has to obtain proper instructions. I cannot base a decision on what’s being said today,” she said.
“They have to submit affidavits and sworn statements.
“The reason for that is when people give sworn statements, they are accountable.
“If you don’t do anything that’s said in your sworn statement, police can charge you or the complainant or the defendant can take you to court for giving misleading statements.”
