TRAINEE lawyers at the Legal Training Institute are going through a commercial litigation and advocacy workshop to acquire some practical skills before they can be admitted to the bar, says Chief Justice Sir Gibbs Salika.
The workshop, the ninth of its type, is designed to strengthen legal advocacy skills and inspire trainees to appreciate the principles and practices behind different areas of commercial law in PNG.
“The practical skill set that you will gain from this workshop will be the foundation of your career,” Justice Sir Gibbs said.
“The commercial litigation and advocacy workshop is an important training programme that is a requirement for you to complete satisfactorily in order to be admitted to the bar.”
In general, the commercial litigation involves virtually every type of dispute that can arise in the business context, including breach of contract cases, partnership/joint venture disputes, business tort, civil claims, breach of fiduciary duty allegations and shareholder issues.
The workshop is beneficial to the trainee as it encourages them to be more competent in handling commercial cases, such as:

  • HOW to correctly articulate the cause of action and pleadings in the litigation;
  • HOW to correctly choose the right mode of litigation;
  • HOW to draft written submission for interlocutory injunction;
  • HOW to prepare for trial and mediate on commercial law cases;
  • HOW to do an application for discovery; and,
  • HOW to handle various other important aspects of being a proficient commercial lawyer.
