A JUDGE has allowed the discontinuation of proceedings filed by former Chimbu acting provincial administrator Joe Kunda that sought to review a National Executive Commission (NEC) decision to advertise the Chimbu administrator’s position last year.
Justice Nicholas Miviri, in the Waigani National Court yesterday, granted a request by Kunda’s lawyer Ricky Joseph to have the proceeding discontinued and directed him to file the relevant orders to discontinue by Sept 27.
Kunda’s application sought to review the appointment of Chimbu administrator Michael Bal Temai on Oct 30 last year.
The defendant’s lawyers from the Solicitor General’s Office, Peter Kuman, who appeared on behalf of Temai, and Henry Monei, who appeared on behalf of former Prime Minister Peter O’Neill, former Public Service Minister Elias Kapavore and acting secretary Taies Sansan, told the court they were ready to move submissions seeking to dismiss the proceedings.
Kuman and Monei also requested that costs be awarded to their clients which was granted by the court.
