Validity of Namah’s applications depend on prosecution

A DECISION on a stay application filed by Public Prosecutor Pondros Kaluwin will determine the validity of a Supreme Court application filed by Opposition Leader Belden Namah questioning the election of Prime Minister James Marape.
This comes after Marape’s lawyer McRonald Nale of Jema Lawyers, was granted leave by Justice Derek Hartshorn to discontinue an application for extension of time in the proceedings.
Nale informed the court that he wanted to get the outcome of the stay application since the stay would determine whether Namah had standing to pursue the matter.
He said if the court granted the stay, Namah would be suspended from duties and would not have the standing to pursue the matter which also included another Supreme Court application questioning the National Pandemic Act and its emergency powers under the constitution.
The decision on stay application will be delivered tomorrow as it seeks to stay the orders of a National Court ruling in favour of Namah on July 16.
