Woman’s warrant extended

THE National Court has extended a warrant of arrest for a 42-year-old woman who failed to comply with court’s orders to allow the warrant to be executed.
Acting Judge Tracy Ganaii made this order at Waigani on Wednesday upon the State’s application to have the warrant extended because Benny Komba Timothy, from Puiapak village in Laiagam, Enga, again had not appeared in court despite a warrant being issued on Tuesday for her to be arrested and brought to court.
The matter returned to court on Wednesday to review order of compensation payment of K2,500 to Pina Ambrose, whom Timothy had stabbed and seriously wounded on July 28, 2019, in Port Moresby, in relation to a land dispute.
Timothy was sentenced to four years in March after being found guilty of grievous bodily harm, however, the term was suspended and she was given three months to pay Ambrose the compensation.
When the matter returned to court last Tuesday for a compliance check, it was found that Timothy had not paid the amount to Ambrose.
The court then ordered Timothy to pay the K2,500 in a week or her suspended term would be revoked and she would be jailed.
When the matter returned to court on Tuesday this week, Timothy was not in court.
State lawyer told the court that she had contacted the probation office on Tuesday and found that Timothy had paid K1,000.
However, Timothy’s non-appearance meant that she had not complied with the court’s orders.
The court ordered for Timothy to be arrested and brought to court on Wednesday.
However, she was not in court.
State asked the court to extend the bench warrant due to Timothy’s non-appearance.
Defence lawyer said she had no instructions from Timothy.
Acting Judge Ganaii ordered that the bench warrant be extended till the matter returns to court.
