Authority given time to respond

A CASE filed by Kuima Security Services seeking incentive orders against National Airports Corporation (NAC) has been adjourned to Thursday to allow NAC to file its response to an additional affidavit Kuima had filed.
Justice Thomas Anis adjourned the matter yesterday after NAC’s lawyer told the court that they needed time to file their response as the security company had filed the affidavit late on Friday.
Kuima’s lawyer Roger Otto told the court that the affidavit gave an account of a decision by NAC to suspend Kuima and Asila for 14 days pending an investigation into an incident that occurred last Monday between the security firms at the Jackson Airport.
Otto claimed that the decision of suspension eased the urgency of the matter before the court.
Kuima filed an urgent application seeking to nullify NAC acting managing director and chief executive officer Rex Kiponge’s decision to terminate the firm’s contract with NAC without giving ample notice.
The firm sought orders in terms of incentive orders to restrain the NAC from giving effect to its decision on March 18 that terminated the firm’s contract.
It claimed that the decision was harsh and oppressive.
