Bid by police in passport case failed

 AN application in court by police prosecutors to have a foreigner remanded in custody failed because of a technical error.

Waigani District Court Magistrate Mekeo Gauli last Friday ruled that the notice of motion filed by police was defective in that it had a signature of a person without a name. 

Gauli said although it was a technical error, it still made the application defective. 

The accused Go Kem San is out on an extended bail of K5,000 and will reappear on March 17 for mention. 

San, 53, is from Kuala Terengga, in Malaysia. 

Police had asked the court to have San remanded in custody after he allegedly disobeyed a court order and obtained his passport from the district court office. 

San appeared at the district court last year facing other criminal charges. 

He was ordered to surrender his Malaysian passport to the court.  

But he somehow managed to get it from the court and used it to travel overseas. 

San appeared in court on Feb 7 charged with dishonest application and false declaration for obtaining his passport from the court house.  

San’s passport has since been returned to the Waigani District Court.
