Boy, 11, gets 4yrs for rape

A JUDGE has sent to prison a juvenile, who raped a six-old-girl, to get him away from his peer group and give him a chance to undergo rehabilitation.
Acting judge Justice John Numapo jailed the grade five student, aged 11 but cannot be named for legal reason, to four years in the National Court in Lae.
“I do not consider the prisoner as a suitable candidate for probation and instead consider incarceration as the most appropriate form of punishment,” he said.
“I say this because he needs to be taken away from the environment he is currently living in, from the bad influences of his peer group, so that he could be rehabilitated to become a better person.”
Justice Numapo said the offence of sexual penetration involving underage children was not only illegal but also morally wrong.
“Sexual penetration of under age children and other sexual offences of similar nature are becoming too prevalent in the country in recent times,” he said.
The court heard that the student committed the offence on Jan 14 this year at West Taraka in Lae between noon and 3pm.
The girl was returning from the toilet when the boy grabbed her hand and took her to the back of the toilet, forcefully removed her clothes and sexually penetrated her.
The court was told he was also carrying a small pocket knife which he threatened the girl with.
Justice Numapo before sentencing considered the aggravating factors and circumstances such as the threat of violence used, use of force and excessive injuries to the girl. He also considered the mitigating factors such as the fact that he was a first-time offender, his age, his early guilty plea and expression of remorse.
He ruled that the aggravating factors and circumstances outweighed the mitigating factors.
The court was told that his grandfather had paid K1,000 as compensation to the girl’s family.
Ten months will be suspended from the four years for the time the boy had already spent in custody.

    He is probably older than the stated age. My guess, he is 14.

  • Seems he is capable of doing it again as he had a knife to threaten the victim, he clearly knew what he wanted. Be should be given the same penalty that would have been given to an adult.

  • It might be his first time but he is probably exposed to such acts already by older boys, watching porn movies, etc…and decided to try it out.

    It is still a serious crime and must not go unpunished. He needs to be included in counselling services as well as serving his teem in full so he can learn a lesson or two.
    He has already stolen a young, innocent child of her innocence and can leave a scar in the future.

  • Our Judges need to be tough like His Honour Numapo. Rapist need be sent for more then 10 years behind bars.

  • This child needs rehabilitation. The fact that he is so young and is capable of committing such an act is shocking, help needs to be given before he continues down a wrong path altogether as he gets older.

  • Rape is reaching the skies in PNG now…Zero improvement. What are the churches doing? What are the parents doing? What are the teachers doing? Can the Pastors and teachers teach and preach about morality in the churcehs and classrooms instead or biology and chemistry, instead of heaven and hell?

  • Such offence is committed because there is not enough awareness carried out by our community leaders, police, health officials and ourselves. We must address it before it happens. We all must work together to address it and find ways to minimise it before it affect our future generation. It is very bad.
