Boyfriend’s attempted murder case struck out

A COMMITTAL court in Lae struck out an attempted murder case on Monday due to insufficient evidence.
Magistrate Pious Tapil struck out the charge against Balty Kaip, 20, from Gagidu in Finschhafen, Morobe, and released him.
Tapil said the medical report did not support the statements provided by witnesses.
Court also noted that a search warrant was not provided by the police when they found a home-made gun on Kaip.
“Whatever comes in court must come in the formal way, follow the procedure when arresting or searching defendants,” he said.
It was alleged that on Jan 4 at Kamkumung in Lae, Kaip and his two friends went to meet Kaip’s girlfriend at Kamkumung market.
Court noted that Kaip borrowed a home-made gun from a friend and took it along with him to the meeting.
The police brief stated that the girlfriend’s family had been searching for her when they came across her with Kaip.
Kaip and his girlfriend’s father and brothers argued and fought.
Kaip allegedly pulled out the home-made gun and fired three times at his girlfriend’s father and brothers and a shot wounded one of the brothers.
The victim was brought to GM Flores hospital and treated and Kaip was later arrested.
