A MAGISTRATE in the Lae Committal Court has warned a man against committing a serious offence when striking out an attempted murder case against him.
Magistrate Pious Tapil discharged Philemon Michael, 40, from Iki village, Mul-Baiyer in Western Highlands, because police failed to present investigation files to the court.
He said police had been given enough time to complete investigations into Michael’s case and to have the files ready for court by Monday (Jan 17).
The court noted that Michael had been attending court for mention on set dates for more than the required time given by the court to police to have his files ready.
“You are lucky that police failed to complete their investigations and have the files ready in court on time so I am striking out your case and will have you discharged,” Tapil told Michael.
He told Michael to go back into the community and be a good citizen.
“If you come back to this court the second time, you will not see the court’s leniency.”
