Court strikes out murder case over lack of evidence

A WAIGANI Committal Court has struck out a murder charge against a 38-year-old woman who was allegedly involved in the killing of a woman in Port Moresby, six years ago for lack of police evidence.
Magistrate Danny Wakikura, last Wednesday, when striking out the case against Sarah Abraham of Dei’s Kendagk village, Western Highlands, said the police hand up brief was not filed and served.
“I struck out the matter because the police file is not ready within reasonable time,” he said.
“The police can arrest Abraham anytime if they have any evidence on her murder charge.”
Abraham was the co-accused of Janet Kina, 38, of Ragula village in Dei, Western Highlands.
Both were charged with murder from the same allegations.
Police prosecutor sergeant Peter Samgy informed the court that the police hand up brief against Kina was served to her two weeks ago but Abraham’s file was not ready.
Defence lawyer John Polowe from Public Solicitor’s Office made the application to strike out Abraham’s case and have her released from custody due to lack of police evidence.
Magistrate Wakikura upheld Polowe’s application and struck out Abraham’s charge.
Police alleged that between 7.30am and 8am on June 21, 2016, Kina and Abraham saw Kina’s husband with his new wife Cathy Wisil (victim) driving from Morata towards Waigani market and allegedly threw stones at them.
Kina’s husband and Wisil allegedly drove straight to Waigani Police Station and reported Kina and Abraham.
