Danaya’s lawyer told to file submission

THE Waigani Committal Court yesterday directed former Western governor Dr Bob Danaya’s lawyer to file a submission in response to the remaining three charges after striking out his conspiracy charge on Aug 8.
Danaya, who is also the non-parliamentary leader for the PNG Labour Party, has been charged with conspiracy, false pretence, forgery and fraudulent uttering.
However, magistrate Rosie Johnson on Aug 8, struck out his conspiracy charge as the persons with whom he had allegedly conspired with were not arrested and charged with the same charge.
Johnson said if anyone was charged with conspiracy, there should be another person facing the same charge too.
“If there is a conspiracy, there should be someone else too,” she said.
Yesterday, she told his lawyer to file a submission and serve on prosecutions at least three days prior to hearing on Aug 30.
She also reminded him (Danaya) yesterday that his conspiracy charge was struck out because it was defective.
Johnson told Danaya that his lawyer had to file a submission and serve a copy on prosecutions by Aug 27 for perusal.
Danaya will however return to court on August 30 when his lawyer will make submissions in response to the remaining charges of false pretence, forgery and fraudulent uttering.
His bail of K4,000 has been extended but he has been reminded that police could charge him again for conspiracy if files for the co-accused were in order.
Danaya was arrested by National Capital District fraud squad in April this year.
The charges relate to a Western provincial executive decision to terminate the appointment of provincial administrator William Goinau.
