Defamation case thrown out

A COURT has thrown out a defamation case filed by a police officer against a provincial police station commander who had charged him with a fraud-related offence.
Sergeant Mathew Nagonda took former Enga police commander Martin Lakari and others to court for breaching his human rights.
Justice David Cannings ruled that Lakari and others had not defamed Nagonda.
Nagonda argued that in 2009, he was arrested and charged with corruptly receiving money from a detainee in his custody.
The District Court ruled that there was insufficient evidence and dismissed the case.
Nagonda ruled that his arrest had defamed him and it breached his rights.
Justice Cannings ruled that Nagonda could not prove that his rights had been breached by Lakari’s instruction to have him arrested and charged.
