ALL necessary court documents concerning a suspect must be filed in court before they appear in court, says a magistrate at the Committal Court in Waigani.
Magistrate Paul Puri Nii said this yesterday when the prosecution team asked for an adjournment in the case of a police officer involved in investigating allegations against police commissioner David Manning, because they were yet to properly lay the information in court.
“Next time when coming to court, all the necessary documents must be brought to court,” Nii said.
Detective Senior Sgt Tinol Pakiapon was in court with his lawyer for arraignment.
“What’s before this court is the application for bail which was withdrawn last Friday.
“We are yet to properly lay in court the information against the accused, therefore we ask for a short adjournment to have that sorted,” Sgt Peter Samghy told the court.
Sgt Pakiapon’s matter was adjourned to Thursday (May 9) and bail extended.
His court bail filed on Thursday was withdrawn on Friday after he was allowed police bail.
His bail matter was dealt with by a lawyer from the Office of the Public Solicitors.
He is now represented by Felix Kua from a private firm.
According to Sgt Pakiapon’s bail request form, he was charged with causing disaffection to the constabulary under the Police Act.
