Foundation seeks to stop search warrant

OK TEDI Fly River Foundation Ltd has filed an urgent application in the Waigani National Court seeking interlocutory injunction orders against search warrants in respect of its bank records.
The foundation’s lawyer, Greg Sheppard, of Young and Williams Lawyers, presented the application yesterday before acting Judge Paul Tusais.
The application seeks to stay and restrain the defendants, their servant or agents from applying for or executing any search warrant in respect of the bank accounts and records of the foundation.
The defendants in the matter are Robert Volo, first defendant, Philip Yonge, the second defendant, Clement Havas, third and the state, fourth.
Search warrants were obtained last December from the Waigani District Court based on a complaint by North Fly MP James Donald.
The foundation was deliberately seeking an ex parte (one party hearing) order, however, Justice Tusais adjourned the matter to Friday after Solicitor-General Tauvasa Tanuvasa informed the court that the state could not respond to the application because it was short served.
