A LAWYER representing three men and a woman on a kidnapping charge has asked a court to dismiss the case because police failed to provide evidence and progress the case.
Diana Koseba, 32, from Kerea village, David Koseba, 24, from Kerea village, John Olea Toua, 28, from Lalako village and Sale Ray, 38, from Kouderika, all in Kairuku district, Central were charged with deprivation of liberty.
Defence counsel Tau Kamuta told the court that the police were delaying their investigations and this was denying the defendants’ right to a fair and prompt judicial process.
“They have been going to court with no police evidence and may I ask the court to dismiss this case due to no police evidence from the prosecution,” he said.
“It costs my clients time and money every time they come to court. May this be the last adjournment?”
Police prosecutor George Vetari told the court that the four defendants were arraigned on March 2 but their police files were yet to be completed.
Central committal court magistrate Hilda David Aipi adjourned the case to next Wednesday.
