Kaiwi’s bail application reserved for Monday

A DECISION on an application for bail by Bosip Kaiwi was reserved for Monday by acting Judge Paul Tusais in the National Court.
Justice Tusais said he needed time to go through all the written submissions by both parties before handing down a decision.
Kaiwi, 25, of Minj, Jiwaka, who was charged with the wilful murder of his partner, Jenelyn Kennedy, in Port Moresby, on June 23, made the application through his lawyer Samuel Inisi.
His grounds for bail:

  •  He has an existing health condition (asthma) and that the medicine needed to treat him, is not available at the clinic in Bomana. This was supported with a letter from the community health worker who treated Bosip when he was admitted at the clinic;
  •  The prison is overcrowded and lacks Covid-19 measures which poses health and safety risks to the detainees, including himself. This was supported by a letter from Bomana operations manager Chief Insp Dimon Gar;
  •  He has allegedly been receiving threats of harm by Correctional Services officials and other remandees.
    He stated in his affidavit that he was assaulted by warders when he first went up to Bomana.
    From then on, he has been receiving threats of bodily injuries, he is in confinement in fear of being attacked and assaulted by relatives of the deceased who are also remandees.
    He says the threat within the CS facility is more serious than outside, thus, he stated that he would be more safer outside; and,
  •  The custody issues of his children Bosip Kaiwi Jr, 3, and Maliah Kaiwi, 1, before a family court proceedings in the town court where he is not named as a party as the surviving parent.
    He stated that if granted bail, he will appear in the family court proceedings as a surviving parent.
    Kaiwi nominated two guarantors, a village court counsel and a serving member of the PNG Defence Force, who had known him for more than 10 years and have pledged surety sums of K1,000 each.
    If granted bail, he will reside at the Telikom compound and comply with whatever conditions the court may impose. The State objected to Kaiwi’s application stating that his health condition was not life threatening; and was being kept in a segregated cell room to minimise security threats.

  • He doesn’t need bail – he is a murderer!! A murderer’s safety shouldn’t be justified and considered on non-life threatening illnesses nor from threats within – he wasn’t considerate of the safety and life on the person he murdered. The acting judge shouldn’t be fooled by all these lame reasons for bail – let him remain in jail and get a conviction!! He deserves to be in jail.

  • Right Man with the right mind, did the right thing at the right place so you deserve to be in that right place Bomana. You already abuse your kids and when you come out what will you do to them?

  • He has a cell to himself which means he is more protected than many other prisoners. His offence is a serious one. Stop looking for excuses. Even if you have human rights, those rights did not give the right to murder your partner who was too young to pass on. You have given so much pain to the relatives of your partner. So be cool and stay where you are.

  • O cry me a river.. boo hoo hoo. Suddenly he wants to be a parent!! He showed how unfit he is as a husband a father and a human being. What suddenly changed. Sounds like a lot of effing BS and looks like money is making the rounds to buy his way out.

  • Support you all. Did he come back to his senses when he was in prison?
    He may have the right to apply for bail but now he does NOT deserve one.

    He took away the right to live from a very young person so full of life. Please just let him stay in there and let him feel it.

    To the good judge out there, it is biblical that, no mercy should be shown to the murderer.

    Grab a Bible and read: James 2:13. I quote;

    “For Judgement is WITHOUT Mercy to the one who has shown no Mercy. Mercy triumphs over Judgement”.

  • Bhosip is no different from any other wife murderer. Just because he comes form a rich elite family does not warrant this news article to take prominence for judge to be lenient and grant him bail. Bhosip Kaiwi, Felix Kange, Richard Namaliu all women faces killed their wives out of jealousy . They should all be castrated and locked up in the same cell in Bomana and given life sentences respectively to meditate and repent of their sins for the rest of their lives .

  • Come on Man, you are not vulnerable since you are segregated from the rest of the prisoners or even likely to be exposed to covid-19.
    You deserve to be there since you committed a very serious crime that doesn’t guarantee your freedom, even with all these lame excuses listed by your lawyer.
    Asthma is not a life threatening sickness. You are a grown up man, use you puffer.
    Serve your time, mate!!! No use crying over the spilt milk.

  • This Bail application by Mr B Kaiwi is successfully deem Null and Unfit to grant him the Bail as per the following reasons on substantiated grounds that;

    1*His health condition is NOT Life-Treating as maybe misinterpreted by the CHW in his letter

    2* He was living in a separate confined cell, thus the claims on overcrowedness and potential risk of Covid-19 is completely eliminated as this can not be substantiated

    3*His treats do not include actual facts; of fighting with inmates or attacked by CS officer during his time in the prison-hence No hard evidence/injuries sustained

    4*He is definitely NOT to be in close contact with his kids or can NOT be allowed to visit his kids until such a time when the kids are ready to see him as he is already a treat to his Family.

    NB: Please let not the Evil (Money) move you to make a judgement but Truth always.

  • Wow! Very dumb reasons to apply for bail! If Kaiwi is putting in an application for bail when already receiving special treatment in prison then his application is a JOKE! If bail is granted then please set all murders free too! What precedence are we setting?
