Kobol files appeal to review court decision

ELECTION petitioner for the Southern Highlands seat Joseph Kobol has filed an appeal in the Supreme Court to review a National Court decision that dismissed an election petition filed against the declaration of William Powi as governor in last year’s national election.
Kobol, through Warikini Lawyers and Consultants, filed the review on June 22 on the grounds that the court had erred in law in failing to provide sufficient and/or proper reasons for its decision to dismiss the petition.
Kobol could not serve court documents to the first respondent, Powi, personally because he was out of the country.
The court then issued an order that the application be served to Powi by way of publication in the two daily newspapers, namely The National and Post Courier, Kobol said Powi’s avoidance at Jackson Airport international terminal to accept the service of court documents was unbecoming of a leader and was uncalled for because such acts could stir up frustrations and cause further law and order issues in the province and the country.
He said the mayhem in Mendi was a demonstration of people not being happy with the leadership at the provincial level as their legal right to choose a leader was being hijacked.
Powi, when contacted regarding his travel overseas, said he had travelled overseas for a medical check.
