Lae court orders developer to vacate recreational property

 THE District Court in Lae has ordered occupant and developer of Morobe Park, formerly Stewart Park, section 27, lot 43, reserved for public recreational development along Butibam Road, to vacate the area.

Morobe Fronts Holdings (MFH) Ltd issued notice to Bagiro Morobe and developer Dokena Builders (DBL) Ltd last Friday.

MFH then sought and was granted orders by the court for the developers to vacate the reserved land.

Bagiro appealed to Morobe Governor Kelly Naru, the provincial executive council, Lands chairman and Lands and Physical Planning Division (DLPP) to clarify the title holder.

DLPP programme adviser Jonah Suvi said that portion of land was zoned as a foreshore reserve by the physical planning board under the Physical Planning Act.

“It was deliberated that the title was with POSF; after conducting title search, the land is unallocated as per rental records. There was never any application lodged by MFH Ltd,” he said.

“Persons, agents or group claiming ownership of the property should produce evidence of ownership. The land is subject to forfeiture due to non-compliance of lease covenant.”
