Madang leaders appear in court over town road conditions

MADANG Governor Peter Yama, Madang MP Bryan Kramer and 13 others appeared before Justice David Cannings yesterday at the Madang National Court regarding the state of roads in the provincial capital and to ascertain which office or authority was responsible for fixing the roads.
The court heard and ordered that they shall, by Jan 18, file an affidavit stating the facts regarding the subject of the court case on who was responsible for maintaining and rehabilitating the roads in Madang town; why the road were in poor condition; what was being done to address the problem; in what manner and to what extent were human rights being infringed by the poor roads; and, whether the court would make further orders or a declaration for the purpose of enforcement of Basic Rights under section 57(3) of the Constitution.
They were directed by the court to ensure that all affidavits were available for inspection at the Registry and emailed to those respondents who provide their email address to the Registry.
The first hearing will be on Jan 25 and the deponents of all affidavits would make themselves available at the hearing to give oral testimony and be subject to cross examination and hearing of evidence.
Justice Cannings also directed that the second hearing would be on Jan 26 and that hearing would be devoted to a hearing of submissions.
