A MAN charged with stealing canned meat valued at more than K132,000 was ordered to return to court on Jan 27 after his application to have the case struck out was refused.
Magistrate Tracy Ganaii adjourned the case of Allan Uru, of Gagbagaba in Rigo, Central, charged with stealing Globe corned beef and Globe Sita canned meat belonging to Carpenters Agriculture and Manufacturing Trading in Port Moresby.
Uru’s lawyer Mark Leo made an application to have the matter struck out since it had been over three months without a police file served on them to proceed with the case.
Police prosecutor Const Shellian Pius told the court that files were completed and ready to be served even though the mandatory three-month period for investigations had lapsed.
Ganaii allowed the prosecution’s request for an adjournment.
“It (case) can be extended if there are special circumstances in the case and one of the special circumstances would be how ready the file is,” she said.
“Because of the circumstance considered I would allow a short adjournment.”
Uru’s bail of K500 was also extended.
