Man found guilty of murder after spearing victim

The National Court in Bomana convicted a  man last Friday for killing another man with a spear following the death of his pig in Kairuku, Central,  last year.
Justice Panuel Mogish found Allan Aiso guilty  of murder.
Justice Mogish said he was satisfied beyond reasonable doubt that Aiso had stabbed   George Evi with a spear knife on the left of his chest and that wound contributed to his death.
“I find the cause of the death to be over a pig. I cannot be satisfied that the killing was intentional,” Mogish said.
“I think it was a spur of the moment reaction on the part of Aiso. He found Evi and Paul Auki standing next to his dead pig.
He was armed at that time. He immediately hurled the spear at the deceased.
I find Aiso was to some extent  provoked and that caused him to stab the deceased.
There was a de facto provocation sufficient to mitigate the intent of the accused.”
On May 5 last year at Aipeana village in Kairuku, Central at around 6am, Evi and his uncle Auki went to a nearby garden belonging to other relatives and found a pig which appeared to have been killed.
Evi and Auki allegedly dragged the pig to their house and if anyone came to claim it, they would let them know.
The State alleged that Aiso arrived at the house and without enquiring about the pig, took out his spear knife and stabbed Evi on the chest and it remained stuck.
Auki allegedly ran off and informed Clothiel Bona Evi (Evi’s wife) who arrived and saw her husband kneeling down with the spear in his chest and Aiso was trying to extract it.
Evi was taken to the village and was confirmed dead.
Aiso is awaiting his sentence.
