THE Waigani Committal Court has struck out a murder charge against a 37-year-old man who was allegedly involved in the killing of a woman in Port Moresby last year for lack of police evidence.
Magistrate Danny Wakikura in striking out the case of Nicky Dembit, from Kala village, Western Highlands, on Thursday said it was the responsibility of the police to prepare the files.
Police prosecutor Senior Sergeant Joseph Sangam informed the court that there had been no progress on the file as the informant had not provided information and asked the court to strike out the case.
Magistrate Wakikura discharged Dembit and ordered that his K1,000 bail be refunded.
Police alleged that the murder was committed by Dembit and his wife (co-accused).
Police alleged that the killing occurred last Sept 7, following an argument between Dembit and his wife after she suspected him of being unfaithful.
Dembit allegedly told his wife to leave their home and return to her family.
Dembit then went out drinking and returned home from a night club with a woman (victim) who was allegedly stabbed and killed by his wife.
Police alleged that Dembit fled the scene after the incident.
The deceased’s body was later taken to the morgue by the St John Ambulance.
Dembit and his wife were arrested the next day. He was later charged with murder.
