OC refers Basil to public prosecutor

THE Ombudsman Commission has referred Bulolo MP Sam Basil to the Public Prosecutor for alleged misconduct in office, on a complaint lodged in 2016.
Chief Ombudsman Richard Pagen in a statement yesterday said an investigation was carried out following the complaint and Basil was given an opportunity to respond to the allegations.
Pagen said Basil requested for and was granted time to respond but after 51 days, he still had not done so.
He said the commission, therefore, decided that there was a prima facie case that Basil had been guilty of misconduct in office.
Pagen said the Ombudsman Commission then served Basil a notice pursuant to section 20 (2) of the organic law on the duties and responsibilities of leadership through his lawyers.
He was informed of the commission’s intention to refer his case to the Public Prosecutor who would decide whether to take it up further to a Leadership Tribunal.
Pagen did not give any details of the allegations but that they were “centred on alleged breaches of section 27 of the Constitution and the relevant provisions of the organic law on the duties and responsibilities of leadership”.
Basil yesterday told The National that a formal statement would be released on the matter.

  • Jame Marape government is good, he is not break any organic law,he is precisely exercising peoples interest and integrity. He is the want have a conscience mine for the people of PNG making right decisions to bring PNG back performing eight plan policy being amendate during in the 1975 PM . The plans make this time not being exercise but Marape did. The leader moving here and there to either side especially in opposition, it seem that your have now confident in you and your people. Your are 100% appointed by the people, do respect the right of people and stand firm and together you can build PNG. as whole. who is in the opposition do not look through the table of content and do necessary suggestion in government side, look through the content and open the page and read and you will understand what is government side do, make judgement before reading, do not just being the follower without confidently reading.

  • Just to avoid prosecution and moving to the opposition is a sign telling us that these corrupt leaders are trying to escape the long arm of the law. No wonder all corrupt leaders are on the other side..

  • Our laws need to change by stripping honorable titles like Sir/Madam ect. For instance, Puka Temu does not deserve the title of Sir! He has tarnished and shamed that prestigious title by being signaled out for official corruption in high office. Whether he has been found guilty or not is not the point. The point is, he has been suspected or has prima facie case(s) been made against him which is good enough for such titles to be taken off him.
    If there is a citizen who is deserving enough of the title Sir is the Grand Chief Sir Paliaus Matane.

    • Idiot. Those cases have been pending for a long time. Basil was given time to respond and he didn’t. That means the OC has to take the next necessary step. Stop speculating.

  • On the head Gary! Can the Ombudsman Commission be Investigated? Though genuine, the timing associated with the execution of these charges seems politically motivated.

  • The laws of the country have finally beginning to expose corrupt leaders and thieves in the opposition. OC has been investigating the MPs for a while. The timing for referral is good and Mr SB is doomed. SB character is tanished by his greed, nobody to blame. He was voted in to get rid of corruption and not to join any political parties and their MPs that have over years of corruption against their names. He did the opposite and will be difficult for him to regain respect once he enjoyed.

    OC, you are doing a fine job so please continue, until a new commissioner is commissioned in ICAC to carry out some of your burdens.

  • The justice system will Judge our Leaders, we citizens must respect them which ever side they are on. Do not jump to conclusions n Judge our leaders. King David didnt touch Saul as he was anointed by God, though saul was after his life.

    • Tepi, all leaders must earn the people’s respect by the their good, honest, transparent, accountable, examplary and God fearing conduct, and leadership traits.

      Only stupid people will waste their respect on those who are corrupt and without integrity.

  • It is very simple, to stop Corruption you must stop Politics. Where ever there is Politics, there is ALWAYS Corruption. Because Corruption is a capsule or fruit of Politics. Politicians are the horticulturist or gardener. They go around plant the seed (Politics) everywhere not considering the fertility of the land. In any moment, a day, a month, a week, a year or even years, it gives an alarming harvest (corruption) of varied seeds. Therefore, to be a politician, you must NOT always fight corruption BUT you must play Corruption and fight Corruption at the same time. This is a way to balance Politics.

  • The 10.2 Million Kina given on a golden plate to Niugini Biomed smells fishy but cannot be investigated by OC. I guess all process was followed or as long as you are with the government you are immune from being investigated.

  • Very interesting to see some power hungry and corrupt politicians who seems to very afraid of this new ICAC bill and grouped themselves on one side to topple the current government and dismantle this ICAC bill.Sam Basil is first on the list so hope to see many are yet to follow,good work OC and your team.

  • One of the main reason that triggers the movement of MP from Government to Opposition in November is now unfolding before our very eyes. These MPs wanted to form a new government with the purpose to divert the leadership tribunal attention away from them. Unfortunately, their plans are out of time.
