A MAGISTRATE at the Waigani Committal Court has found sufficient evidence to commit a 25-year-old-woman to stand trial in the National Court to answer to pornography charges.
Magistrate Tracy Ganaii made the ruling yesterday after finding sufficient evidence against Sharmillah Pawa, who is alleged to have intentionally used her mobile phone to send pictures of her private parts to her boyfriend at Morata 2 in Port Moresby.
It was alleged that between July 1 and Aug 30, 2019, Pawa of Komome village in Ialibu, Southern Highlands, used her mobile phone and transmitted images of her private parts to another person Rex Kuman.
Magistrate Ganaii went through witness statements from Pawa’s ex-husband, who is the complainant, and three police officers attached to the Gordon Police Station as well as the arresting officer Phillip Otto before making the ruling. She also considered Pawa’s defence submission that she had committed the offence because her de facto husband kicked her out of his home when she was five months pregnant after she accused him of having an extra marital affair.
Pawa submitted that what she committed was a way of payback to her ex-husband because of the distress he caused to her.
She also admitted that she and her boyfriend Rex Kuman were exchanging pictures of their private parts because the conversation they were having on WhatsApp was sexual in nature.
Pawa’s actions were discovered by her ex-husband and a formal complaint was laid against her at the Gordon Police Station.
She was arrested and charged under section 17 (1) of the Cyber Crime Code Act.
Magistrate Ganaii adjourned the case to March 24 to allow Pawa, whose bail was extended, to file her section 96 statement..
Her bail was extended.
