Ruling on Friday for Manning’s case

A THREE-MAN Supreme Court bench will deliver its ruling on Friday whether to dismiss an appeal filed by the State against a National Court decision that found Police Comm David Manning’s appointment as unlawful.
The bench comprising Justice Peter Toliken, Justice Stephen Kassman and Justice Ellenas Batari will also rule on the application filed by sidelined ACP (human resources) Sylvester Kalaut and former DCP (operations) Fred Yakasa.
Yesterday, at the hearing of the application in Waigani, the judges encountered an issue on the part on time regarding when the application was filed and the time the office of the Police Department secretary was dismantled.
The judges also found that the State failed to serve Kalaut and Yakasa the draft index appeal book which had delayed the hearing of the appeal and caused both men to file for dismissal of the appeal for want of prosecution.
