State solicitor unable to find materials

STATE Solicitor Daniel Rolpagarea told a commission of inquiry that he was not able to identify the materials that he had been asked to produce to the commission.
The materials included two letters he had tendered as evidence in his earlier appearance in relation to his advice on the Union Bank of Switzerland (UBS) loan transaction.
One of the letters stated that the UBS transaction was in breach of section 209 (1) of the Constitution and should not proceed.
The other letter stated that the UBS transaction was good to go given the urgency by NEC.
“I wasn’t able to identify the two documents, I did search but I was not able to find them,” he said.
“We may have had discussions, and I may have been given some notes during discussions, so I wouldn’t change my position now.”
Question put to him: What was your view, whether the LNG state participation Act was sufficient for the IPIC loan?
He said: “Yes, it was sufficient.”
When asked what specific piece of legislation was approved in a specific loan.
He said he could not recall a specific legislation approving a loan.
