THE University of Goroka (UoG) may be a government body as it displays some characteristics of an entity which is part of the State, but it is “not a State entity”.
Justice Oagile Bethuel Dingake said in a National Court ruling in trying to determine whether or not the university was a state entity.
He said while UoG was a government body subject to Public Finances (Management) Act with few exceptions, had its staff subject to the Salaries and Conditions Monitoring Committee Act, and its laws required Parliamentary approval, there were many other factors indicating that it ran “on a daily basis as an independent body free from government direction or control”.
“An entity is part of the State only where it was subject to government control both in management and conduct of its affairs,” Dingake said from a previous case.
The ruling was regarding a case where the plaintiff Saki Ipata successfully claimed unpaid rentals and damages from UoG.
