A COMMITTAL court in Waigani has struck out the case of a man charged with assaulting and causing bodily harm in Port Moresby last year.
Magistrate Paul Puri Nii said the case against Waima David lacked evidence and that it had been adjourned several times for police to establish evidence that was not forthcoming.
On Nov 28 between 7.30pm and 8pm, David, 22, from Rigo’s Kaparoko village in Central, was at Alotau Street, Gerehu Stage 4.
David was allegedly under the influence of alcohol, armed with an iron bar, harassing and disturbing the public.
He was also allegedly stopping passing vehicles.
Police also alleged that David destroyed market tables on the roadside and canteens.
Taxi driver David Parua was dropping off a passenger when he saw David on the street.
As he drove by, David allegedly smashed the left side grille of Parua’s taxi.
Parua then got out of the vehicle and called out to David telling him that he knew him and asked why he did that.
David allegedly replied that he did not know Parua, came around the vehicle and allegedly hit him once on the head with the iron bar.
David allegedly swung the iron bar a second time but Parua grabbed hold of David and the iron bar.
Parua then felt dizzy and bystanders went to his aid.
David was caught and brought to the Gerehu police station on Nov 29.
On Nov 30, he was brought to the Boroko police station for questioning and charged when he allegedly admitted to committing the offence.
