Full court directed to clarify Namah bid

CHIEF Justice Sir Salamo Injia has directed a full court to clarify an order it issued on April 26 in an application filed by former Opposition leader Belden Namah.
Sir Salamo said Order Six in Namah’s application needed to be clarified by the court which issued it.
The order reads: “Both the Australia and Papua New Guinea governments shall forthwith take all steps necessary to cease and prevent the continued unconstitutional and illegal detention of the asylum seekers or transferees at the relocation centre on Manus Island and the continued breach of the asylum seekers’ or transferees’ constitutional and human rights.”
The matter was adjourned from last Thursday to yesterday for lawyers to inform the court on the final position of the parties in relation to the resettlement of the asylum seekers.
Lawyer Laias Kandi, representing the Minister for Foreign Affairs and Immigration, said the Government was responsible for the resettlement of the asylum seekers, while Australia would be providing financial assistance.
He said the Government was ready to enforce Order Six in the Namah’s application.
Lawyer Ben Lomai, representing the asylum seekers, said it was the responsibility of both governments to resettle the asylum seekers.
But Sir Salamo said it would be better for the full court to clarify the order because it was broad.
The matter will be heard by a three-man bench which is yet to be appointed by the chief justice.
