Ganaii to rule on withdrawal of case

MAGISTRATE Tracy Ganaii will make a ruling on Nov 30 whether to strike out a case of military officer Lt Murray Oa charged with assaulting his wife Debbie Kaore.
Police Prosecutor Chief Sgt Koniu Polon yesterday, at the Waigani Committal Court, confirmed that Kaore had lodged a letter to the arresting officer seeking to withdraw the case.
Sgt Polon informed the court that instructions of withdrawal were from the arresting officer.
However, Sgt Polon opposed to the withdrawal of the case and asked for the committal process to take its course as he had submitted the files of the case which were being served.
Magistrate Ganaii will rule based on evidence found on the police hand-up brief since parties won’t be making any submissions on the evidence.
Oa, 33, from Waima village in Kairuku-Hiri, was charged with causing grievous bodily harm to Kaore at Goldie Barracks on June 4.
