A MAN will stand trial in the National Court for attempting to kill his wife, despite her request that the case be withdrawn.
Committal Court Magistrate Paul Nii ruled that there was sufficient evidence to commit Pelleya Musmapun, 30, of Tuberi village in Mendi, Southern Highlands to stand trial. Magistrate Nii said that his duty under the District Court Act was to assess evidence after the police file was served.
And he now must make a decision after the police file was served.
“Musmapun may raise the issue of withdrawal of information and allegation in the trial court once evidence is tested. I do not have powers to withdraw information,” Magistrate Nii said.
Police alleged that on Sept 24, 2020, in Port Moresby between noon and 1pm, Musmapun attempted to kill his wife over a domestic issue relating to a credit obtained from another person.
Police alleged that Musmapun attacked his wife using two iron rods but was stopped by people nearby.
The wife sustained injuries and was taken to the Port Moresby General Hospital.
Bystanders took Musmapun to the police station where he was arrested and charged for attempted murder.
