Manning, Kaluwin to appear before COI to discuss prosecution of loan deal

Police Commissioner David Manning and Public Prosecutor Pondros Kaluwin will appear before the Commission of Inquiry (COI) into the Union Bank of Switzerland (UBS) loan deal tomorrow to discuss prosecution.
Commission chairman Sir Salamo Injia said Comm Manning and Kaluwin were to prosecute offences committed under the COI Act.
Sir Salamo said the prosecution would be mounted by the police or the public prosecutor.
“For example, an offence under Section 11 (says if) a person is summoned to appear and fails to appear, then it is an offence,” he said.
“I’d like to be advised of what the processes are if this commission is referring a person under the Act for prosecution, what the steps are taken by the police or the public prosecutor.”
He said prosecution for contempt was accepted, “meaning the commission has its own powers to prosecute”.
Sir Salamo said according to information from the COI secretariat, there had been no prosecutions despite the number of commissions being conducted.
“If there hadn’t been any prosecution then the police and the public prosecutor may have experiences to offer,” he said.
“The commission would like to prepare itself and to start referring people under the Act for prosecution.
“The COIs in the past may have a perfect record of attendance but I’d like to explore that so that there would be arrangements put in place for referrals to be acted upon with new expedience and dispatch for reports to be made to the commission.”
